Liability Waiver & Assumption of Risk

By participating in any Ocean Faith Watersports activity, I acknowledge and agree to the following.
1. The activity. I am booking/participating in watersports and/or boat activities operated by Ocean Faith Watersports, its owners, crew, employees, agents, vessels and equipment (the "Operator"), at Palm Beach, Noord, Aruba.
2. Inherent risks. I understand that watersports involve inherent risks that cannot be eliminated, including (depending on the activity): rough water, weather and currents; falls, collisions and impact; contact with the vessel, tow lines, equipment or marine life; drowning or near-drowning; motion sickness; sunburn and dehydration; and injury during boarding, riding, towing (banana/tube), water skiing, wakeboarding, snorkeling, kayaking, paddle boarding, or catamaran sailing.
3. Voluntary assumption of risk. I voluntarily choose to participate and accept these inherent risks.
4. Health and ability. I confirm I am in suitable health to participate, and I have disclosed any relevant medical condition, pregnancy, or inability to swim. I will follow all safety instructions and crew authority, wear a provided life vest when required, and not participate under the influence of alcohol or drugs.
5. Limitation of liability. To the maximum extent permitted by Aruba law, I agree that the Operator's liability for loss, damage or injury arising from the ordinary risks of the activity is limited. This does not exclude or limit liability for intent ("opzet"), gross negligence ("grove schuld") or conscious recklessness, for death or personal injury caused by the Operator's fault, or any liability that cannot be excluded under Aruba law. This is an assumption of risk and limitation of liability — not a blanket release of all claims.
6. Indemnity. I agree to hold the Operator harmless from claims arising from my own failure to follow instructions or my misrepresentation of my health or abilities.
7. Minors. As parent/guardian, I consent to their participation, accept these terms on their behalf, and agree to indemnify the Operator as above.
